Resolution of the administration and appeal
The competent body of the Public Administration is the one who must respond to our appeal, for this it must issue a resolution within a maximum period of one year from the time we filed the Brief of Allegations. If we had paid the fine with the 30% reduction, the Administration will not issue any resolution, except if the offense committed involves the withdrawal of a driving license.
It may be that the resolution of the Administration gives us the reason, otherwise if we want to continue claiming, we can file an "Appeal Appeal" within a month from the competent body issued the resolution. This appeal is filed before the highest hierarchical body that issued the resolution (you can read the data of this body in the notification you have received). In the Appeal Appeal you will have to include all your personal data, identify the number of the resolution you are appealing and what are your reasons for appealing it.
The resolution issued by the Administration to our Appeal Appeal ends the administrative route, which means that from that moment on, if we want to continue to complain, we have to do it in court, with the expenses involved. There are only a few very specific cases in which you can continue to complain to the Administration through the “Extraordinary Appeal for Review” (factual error, appearance of documents of essential value, etc.).
Suspension of driving license
If we have committed an offense in which our driving license is withdrawn, in addition to the fine imposed on us, we must deliver our license to the Sanctions Unit of the Traffic Headquarters, instructor of the file or in our home. The deadline we have for this is indicated in the notification we have received.
Sometimes the sanction includes the immobilization of our vehicle, which will be sealed or immobilized in a way that prevents its circulation. The expenses arising from this deposit or immobilization of the vehicle will have to be paid by the owner of the vehicle in traffic.
